1. Purpose and identity of the seller
These Terms and Conditions of Sale apply to orders placed through Guitar Icons. The seller operates under the trading name Guitar Icons as a French sole trader under the micro-enterprise regime, based in 84350 Courthézon, France. The seller benefits from the French small-business VAT exemption. Contact: contact@guitar-icons.com — +33 6 25 90 79 14.
2. Products
The store sells collectible miniature guitars and, where offered, gift boxes or assembled sets. Essential characteristics, known dimensions, images, prices and availability are provided before ordering. Photographs are descriptive; minor differences in display or finish may occur without changing the essential characteristics advertised.
References to artists, bands, brands, guitar shapes or musical worlds are used to identify or classify models. An official licence, affiliation or exact historical reproduction is claimed only where expressly documented.
3. Prices and charges
Prices in euros are those displayed when the order is placed. Guitar Icons benefits from the French small-business VAT exemption and does not charge VAT. Shipping charges, discounts and the total amount due are shown before final confirmation.
4. Ordering process
The customer selects items, checks the basket, provides the details needed for delivery and payment, and confirms the order after having an opportunity to correct errors. Final confirmation entails an obligation to pay the stated amount. An order summary is then sent on a durable medium using the methods configured by the store.
5. Payment
Available payment methods are displayed during checkout. Payment is processed by the provider configured by the store. The store does not directly retain full payment-card details where processing is delegated to a payment service provider. An order is considered paid only after payment has been confirmed.
6. Availability
Stock quantities are monitored by the store and may be temporarily reserved during payment. If an item unexpectedly becomes unavailable after ordering, the customer is informed promptly and offered a solution consistent with their rights, including a refund where fulfilment is impossible.
7. Delivery
Available destinations, shipping methods, charges and estimated delivery times appear on the Delivery page and during checkout. The applicable delivery period is communicated before the contract is concluded; where no period is agreed, statutory rules apply, including delivery without undue delay and no later than thirty days after conclusion of the contract. Risk of loss or damage normally passes when the consumer physically receives the goods, subject to statutory exceptions.
8. Right of withdrawal
For distance sales of goods to consumers, customers generally have fourteen days from receipt of the goods to notify their decision to withdraw without giving reasons, subject to applicable statutory exceptions. Notice may be given by an unequivocal statement or using the model withdrawal form provided on the Returns and Refunds page.
After giving notice, the goods must be returned within fourteen days. Customers should contact support@guitar-icons.com to obtain the complete return address and necessary instructions; the full postal address must be communicated before return. For ordinary withdrawal, direct return shipping costs are borne by the customer if this was disclosed before purchase. Returns involving a defect, non-conformity, damage or error attributable to the seller are covered by Guitar Icons. Further details appear on the Returns and Refunds page.
9. Refund following withdrawal
Where withdrawal is validly exercised, refundable sums, including eligible standard delivery charges, are repaid within fourteen days of being informed of the withdrawal decision. The seller may defer repayment until the goods have been received back or proof of dispatch has been provided. Additional costs incurred by voluntarily choosing a more expensive delivery method than the standard option offered are not refunded where the law permits their exclusion.
10. Statutory guarantees
Consumers benefit from the statutory guarantee of conformity applicable to goods sold by a trader and, where the relevant conditions are met, the warranty against hidden defects. For goods covered by the statutory conformity guarantee, the seller remains the consumer's point of contact. To report a defect, non-conformity or damaged item, email support@guitar-icons.com with the order number and relevant supporting information.
11. Liability
The seller remains responsible for properly performing their obligations within the limits provided by law. Nothing in these Terms excludes statutory guarantees or mandatory consumer rights.
12. Personal data
Processing of personal data relating to accounts, orders, payments, delivery, contact requests and administrative obligations is described in the store's Privacy Policy.
13. Complaints and consumer mediation
In the event of a dispute, customers may submit a written complaint to support@guitar-icons.com. Subject to applicable law, consumers have the right to use consumer mediation free of charge after an unresolved prior complaint. Guitar Icons has not yet provided the details of a formally appointed mediator; these details will be added once a mediator is appointed. This omission does not limit any statutory consumer right.
14. Applicable law
These Terms are governed by French law where the seller is established in France, without depriving consumers of any more protective mandatory provisions applicable in their country of residence within the European Union. The parties favour amicable resolution before initiating legal proceedings.
